Silver Point’s Defense

In federal court filings from February, Silver Point argued that Fortgang served solely as a legal consultant, not an investor, and was therefore exempt from standard compliance requirements.

On Thursday, the company stated, “There was absolutely no basis in evidence or law for the claims made by the SEC, and the SEC should never have filed this case in December 2024.”

The SEC declined to comment on the matter.
